Dear Members and Advocates:

We are close. Yes, negotiators remain apart on an overall deal for the next COVID-19 relief package, but 501(c)(6) organizations are close to gaining access to the Paycheck Protection Program (PPP). Fortunately for our community, expanding PPP to nonprofit associations and other 501(c)(6) organizations holds broad bipartisan support in both chambers of Congress.

The issues that repel negotiators, such as state funding, do not include PPP expansion to 501(c)(6)s. That said, we must do everything we can to keep this issue top-of-mind for Congress and the Administration. The more time goes by, the more opportunity for progress to recede. This is true for any issue, but we have the power to prevent that.

New Sign-On Opportunity

ASAE is pleased to announce a new community sign-on letter – focused solely on PPP – that urges Congress to pass relief legislation and support 501(c)(6) organizations. Add your organization by the September 14 deadline.

In addition to providing for 501(c)(6) eligibility on equitable terms, the letter calls on Congress to enact the following PPP-related provisions:

  1. Reauthorize until at least March 31, 2021;
  2. Include 501(c)(6) nonprofits in the so-called “second draw” program;
  3. Expand the definition for eligible “receipts” within the “second draw” program to include in-person event cancellations and lost revenue from certification programs and other education; and
  4. Apply lobbying language as outlined in Section 90001 of the HEROES Actand included in the broadly bipartisan Local Chamber, Tourism, and 501(c)(6) Protection Act of 2020 (H.R. 6697).

As a reminder, the lobbying language referenced in #4 above would prohibit borrowers from including salaries of all federally registered lobbyists on staff in PPP loan term calculations. We reported last month on harmful lobbying restrictions presented in the Senate.

Will They, or Won’t They? 

We’ve been through this exercise before. About a month ago, there was a chance for an agreement, but negotiations didn’t produce. Now, with government funding set to elapse at the end of September and the elections right around the corner, predictability is elusive. But we can try, and here’s how we see it:

Our priority is to help secure an agreement by the end of September. October will be largely dedicated to political activities ahead of the elections and anything after that may depend on election results.

The best thing we can do right now is raise the volume on our collective voice. Congress and the Administration need to hear us, so make them listen and add your organization to our community sign-on letter.

DFWAE Cares Grants Now Available

The DFWAE Cares grant program was established in July 2020 by the DFWAE Board of Directors after members expressed a desire to donate time, talent or treasure to support others in our community who are going through a time of need. Particularly related to the COVID-19 pandemic, there are professionals in associations, CVBs, hotels, service providers, and other disciplines who have been furloughed or laid off and are unable to pay their DFWAE dues. This time is critical for them to remain a member so that they can network to find new opportunities and keep up their credentials and education.

A Message from ASAE: The Essential Pillars and Purpose of American Associations

We are excited to announce a new ASAE messaging piece to support our members and the nonprofit association community: The Essential Pillars and Purpose of American Associations. This document is intended to correct misconceptions about nonprofit associations and their purpose and function in the economy and society at large. Please feel free to share broadly.

Outlined are four facts about the nonprofit association community:

1.       Associations began prior to our nation’s inception and remain a foundational instrument of American economy, society and democracy. 

2.       Associations contribute in direct and significant ways to U.S. economic stability and societal advancement.

3.       Associations engage in a wide variety of activities that benefit industries, professions and workers through far-reaching career and economic development programs.

4.       Associations, alongside any American individual, organization or business, reserve their Constitutional right to lobby the government as provided for by the First Amendment in the Bill of Rights.

New ASAE Letter to Congress

Today, ASAE delivered to Congress this document and a letter that outlines our priorities before legislators begin negotiations on the next major relief package. The letter continues ASAE’s urgent requests for Congress to expand eligibility under the Paycheck Protection Program to include 501(c)6 nonprofit associations. Supported by many Members of Congress from both parties, this priority is crucial to the financial stability of nonprofit associations nationwide as we struggle with the economic ramifications of COVID-19.

As the economic and safety impact of COVID-19 has evolved, this letter further reflects our current thinking on how to best sustain our community and save imperiled nonprofit associations. To that end, we also provide several additional policy recommendations to support our community moving forward:

·       Expand employer assistance policies;

·       Ensure a safe return to work;

·       Support families and workers; and

·       Pass policies that ensure a broad-based economic recovery.

ASAE staff continues to emphasize the critical need for PPP expansion to legislators and their staff. We expect more details on Congressional negotiations soon and will report to our members and stakeholders as those conversations develop.
